Regular Meeting Minutes: December 17, 2007

The regular meeting of the Sleepy Hollow Corporate Authorities was called to order at 7:30 p.m. In attendance were President Pickett, Trustees Finney, Fudala, Prigge, Wind, and Ziemba, Police Chief Montalbano, and Clerk Olson. Trustee Getz was absent.

President Pickett explained the rules for speaking under the public comments section of the meeting.

Minutes:

  1. WIND MOVED WITH A SECOND FROM PRIGGE TO APPROVE THE REGULAR MEETING MINUTES OF DECEMBER 3, 2007. On page 2, President Pickett’s title should be corrected and on page 3, there are spelling corrections under Finance, #1 (GASB) and Public Buildings, #3 (dams). MOTION PASSED.

  1. PRIGGE MOVED WITH A SECOND FROM WIND TO APPROVE RESOLUTION NO. 374 ENTITLED “A RESOLUTION ESTABLISHING DATES OF REGULAR MEETINGS OF THE BOARD OF TRUSTEES OF THE VILLAGE OF SLEEPY HOLLOW FOR THE CALENDAR YEAR 2008.” MOTION PASSED.

Engineer:

  1. The projects update was reviewed. Trustee Prigge asked that he be advised by the engineer of any information or documentation received on the Lake Sharon dam project. He also noted that the Village is applying for a trail grant in conjunction with the Township grants for the connecting pathways, but it is not due until August. He will remain in contact with the Township regarding this matter.

Director of Finance:

  1. WIND MOVED WITH A SECOND FROM PRIGGE TO APPROVE THE ACCOUNTS PAYABLE OF DECEMBER 17, 2007 IN THE AMOUNT OF $104,227.73. AYE: WIND, PRIGGE, FINNEY, FUDALA. MOTION PASSED.
  2. FINNEY MOVED WITH A SECOND FROM WIND TO APPROVE ORDINANCE NO. 2007-27 ENTITLED “N ORDINANCE MAKING APPROPRIATION TRANSFERS FOR CORPORATE PURPOSES FOR THE FISCAL YEAR BEGINNING MAY 1, 2007 AND ENDING APRIL 30, 2008.” AYE: FINNEY, WIND, FUDALA, PRIGGE. MOTION PASSED.

  1. Jim Krenz introduced himself as a candidate for the Illinois 49th District representative position and discussed his background and the position.
  2. d Akemann introduced himself as a judicial candidate in the second sub-circuit and gave some background information on himself.

Finance:

  1. ZIEMBA MOVED WITH A SECOND FROM FINNEY TO APPROVE ORDINANCE NO. 2007-28 ENTITLED “TAX LEVY ORDINANCE.” AYE: ZIEMBA, FINNEY, FUDALA, PRIGGE, WIND. MOTION PASSED.
  2. Trustee Ziemba briefly discussed the monthly financial statements. It may be necessary for the Village Attorney to request information from the City of Elgin in relation to the sales tax funds we are to receive. Trustee Finney noted that sales tax revenue to the Village from all sources is a very minor percentage of the Village budget.

Muhich, the Village insurance agent, discussed the long term disability plan modifications for Village employees and Village options for taxability on the benefit. A summary sheet of the options was reviewed by Brian Muhich and the Board agreed it does not wish the employees to be taxed for the benefits. Although the premium payment will be deducted from the covered employee’s pay, the Village will “gross up” the employee’s salary to an amount equal to the amount being deducted for the long term disability premium plus a few dollars extra to cover the additional taxes the employee will incur by increasing their salary. ZIEMBA MOVED WITH A SECOND FROM WIND TO APPROVE OPTION 2(a)ii WITH A GROSS UP OF THE PREMIUM TO THE EMPLOYEE’S SALARY. AYE: ZIEMBA, WIND, FINNEY, FUDALA, PRIGGE. MOTION PASSED.

Police & Public Safety:

  1. Trustee Wind suggested the Village implement a $30 fee for all arrests to help defray the costs. This is allowed per statute and would be paid by the individual arrested. Trustee Finney did not agree with this fee, especially if the person was later found not guilty of the offense for which he was arrested. WIND MOVED WITH A SECOND FROM ZIEMBA TO INSTRUCT THE VILLAGE ATTORNEY TO DRAFT AN ORDINANCE IMPLEMENTING THIS FEE. MOTION PASSED WITH FINNEY VOTING NAY.

Public Buildings & Environmental

  1. Trustee Prigge has completed the Tree City USA application and is ready to submit the packet to the Illinois Department of Natural Resources. PRIGGE MOVED WITH A SECOND FROM ZIEMBA TO SUBMIT THE APPLICATION TO THE IDNR FOR TREE CITY USA CERTIFICATION. MOTION PASSED.

Building & Zoning Enforcement:

Old Business:

  1. The Saddle Club resident who did not have the stone laid along the street edges of his property was sent a letter from the Village Attorney, but the addition of stone will probably have to wait until spring. This will be done at the homeowner’s expense. There was Board comment that Arrow was responsible for putting down the stone, regardless of the resident’s wishes, although the resident had apparently indicated he would pay for the stone to be laid if it was later required by the Village. Trustee Prigge spoke with a former Arrow employee who indicated that laying soil rather than stone in future road work should not be a problem, nor should we need such a wide stone shoulder. We are still retaining a portion of the payment to Arrow until the engineer recommends final payment after all issues are resolved.
  2. The issue of the dead tree on Sleepy Hollow Road is still unresolved. We will be contacting Nicor in the near future.

New Business

  1. The tax bill on the wetland mitigation property will be reviewed by the Finance Committee to determine whether to object to this assessment.
